Over the weekend I was detained for 48 hours, cause I punched a dude in the face, who was threatening to do the same to me. Now I'm ill as hell with a sore throat, fever, headache, earache, coughing up blood and the whole shebang. I had some bloodwork done on Sunday, and some of the values were way off. Gonna have more done this Friday, and then get results Monday. In the meantime: FML.

Unfortunately, it isn't that simple. If you shut up, you're viewed as uncoorporative, which doesn't help your case. Lawyers are only free if you win the case. I dunno yet if I'll be going to court for this, but tbh, I've done worse and at least this time I can claim that I was acting in self-defense.

Denmark's weird. You guys don't have an actual human rights compatible penal procedure?
I mean you have a right not to participate/help your own incrimination. Over here, lawyers are free depending on your ressources, but always when you are detained, unless you want your own.

Of course I have the right not to say anything/incriminate myself, but with eyewitnesses and such, I might as well give them my version of the story, which might end up helping me. Without my version, they wouldn't know that I had been threatened for instance. And yes - they are free until the case is over, and then depending on the outcome, you either have to pay or you don't.

Here costs don't follow the event if you are using a public defender and not your private lawyers, in civil, penal, administrative or whatever courts - no point in taking money from people who don't have any, enough time/effort lost already. Assistance when detained is always free, no matter if it goes to trial or not, as long as it's not your own lawyer but a public defender appointed by the bar association. Funny how it works for you guys. I though this was pretty standard in Europe because ECHR/EU fundamental rights conventions being in force in the same fashion, but that might be a broad generalization as I haven't studied in details the entirety of the ECHR case law on article 6. Yet.
Anyhow, thanks for the comparative law fun. Hope you find a positive resolution of these sucky events
